It takes a lot for a California judge to grant a motion for a new trial.  This judge clearly felt that reasonable jurors could not have found Greyhound without negligence in this bus crash.

Nothing can be more devastating than the loss of a child.  Adding additional burden to the loss is knowing that the accident could have been prevented if the trucker had proper rest and was not driving drowsy behind the wheel.  Investigators will have to determine if this was the case while a mother mourns.

Wal-Mart Stores Inc. said it wants to settle a negligence lawsuit by actor-comedian Tracy Morgan, a day after blaming the celebrity for injuries he sustained when his limousine bus was struck by a speeding company truck.
Steven M. Sweat's insight:

Given the facts as alleged (i.e. that the driver of the Wal-Mart commercial delivery truck was traveling at an excessive speed and otherwise operating his truck in an unsafe manner), and given the celebrity status of Tracy Morgan, it is probably wise to seek an early resolution of the civil lawsuit.  Wal-Mart took a lot of heat for blaming the victim's injuries on lack of seat belt use but, as their legal representatives point out, this was in the form of an Answer to the lawsuit.  Such pleadings must allege "affirmative defenses" and not wearing a seat belt constitutes such a defense of "comparative fault". Nevertheless, the PR on this issue can only go south on the giant retailer the longer the litigation drags on in my opinion.

The Rhode Island Supreme Court affirmed the decision of the Providence Superior court that a truck driver was negligent for driving a vehicle too fast, considering the slippery street surface. Driving too fast for the  road conditions caused his Truck to Crash  into his home and resulted in his house being demolished, eventually. The decision also pertains to Rhode Island Insurance Law and Subrogation but those issues are outside the scope of this negligence post.

The RI Top Court sitting in Providence gave a lukewarm endorsement to the trial justice’s finding of negligence noting the “paucity of evidence” establishing negligence and the RI accident Laws that a motor vehicle sliding or skidding in itself does not prove negligence.

This is a startling report from CNBC regarding the lack of proper oversight for U.S. trucking companies with serious safety violations including employing truckers with a history of drug use and DUI.  So called "Chameleon Carriers" are skirting the laws and legal liability by simply shutting down one trucking company and opening a new one under a different name.  The death of this trucker who was stopping to do a routine maintenance check was one tragic result of just such conduct.

NEWARK, N.J. (AP) — Actor-comedian Tracy Morgan has settled his lawsuit against Wal-Mart over a highway crash that killed one man and left Morgan and two friends seriously injured. Morgan suffered head trauma, a broken leg and broken ribs and is still recovering. The truck driver, Kevin Roper, of Jonesboro, Georgia, faces several criminal charges, including death by auto, in state court. According to a criminal complaint, Roper was operating the truck without having slept for more than 24 hours. A preliminary investigation by the National Transportation Safety Board estimated that Roper was driving 65 mph in the minute before he slammed into Morgan's limo van on the New Jersey Turnpike.
Steven M. Sweat's insight:

Not surprising to see that this case has now been fully resolved with all parties including Tracy Morgan and his associated, who died in the incident.  On average about 95% of all civil cases for personal injury or wrongful death resolve by way of a settlement. This is due to the risks and costs associated with proceeding to trial and facing an adverse judgment, appeals and other costly and time consuming judicial proceedings.

The U.S. Supreme Court has denied motions seeking to overturn a ruling that upheld a California statute requiring a paid 10-minute rest break every four hours and a paid 30-minute meal period every five hours for truck drivers.
Steven M. Sweat's insight:

Every employee in the state of California is entitled to both meal and rest breaks.  This includes a minimum 10 minute break for every 4 hours worked and a 30 minute meal break for every five hours worked.  Trucking companies in California including Penske Logistics attempted to argue that these rules were pre-empted by Federal laws on interstate trucking.  The U.S. Supreme Court disagreed.  As a California trucking accident attorney, I think any rules which require mandatory rest and meals will increase the safety on our roads.

The oversized cargo haulers are limited by law to operating during restricted hours.  They are arguing that this limitation on driving should make them exempt from a requirement to rest at least once during the first 8 hours of a shift.   It will be up to the Federal Motor Carrier Safety Administration (FMCSA) to determine if they should be exempt.  The mandatory rest breaks were implemented as a measure to try to reduce trucking accidents caused by driver fatigue.

Currently, the Federal Motor Carrier Safety Administration (FMCSA) requires truck drivers to take a half-hour break during the first eight hours of a shift. This provision went into effect in July 2013. The Hours of Service rule also contains an 11-hour driving limit and a 14-hour day limit.


The specialized carriers say the one-size-fits-all rest break requirement shouldn’t be applicable to them because they are restricted to operating during limited time periods according to required permits. Their limited travel windows can vary by state and jurisdiction.


These specialized carriers and drivers are required to have a permit issued by a government authority whether they travel with or without an escort. The hours that an oversized or overweight load can travel could make it difficult to schedule a required 30-minute rest break, they contend.


According to the submitted request, the regulation could also place other drivers at risk since a truck and its load may be parked for hours or days along highways or by ramps at state lines while waiting for the next jurisdiction’s travel permit.


In addition, they argue that the breaks can cause hardship for truckers trying to find a parking space big enough to accommodate the oversized or overweight load.

Big rig accidents are dangerous to begin with but, when you are dealing with a double trailer carrying hazardous materials, the danger factor increases substantially.  Unfortunately, this was the case in this fiery crash near Palm Springs, CA.  Apparently, the truck drifted off the road and into a guard rail, which may indicate that the driver had become either fatigued or distracted.  It will be interesting to see the results of the CHP investigation on this one.
