Gail Gaston’s lawyers filed the wrongful death lawsuit in Fresno County Superior Court against Willow Creek Heathcare Center on behalf of the estate of Josephine Mino, who died March 31, 2014, of respiratory failure and pneumonia.

A wrongful death lawsuit has been filed against a Clovis, CA nursing home owned by Skilled Healthcare Group, Inc.  This company is no stranger to lawsuits alleging elder abuse and medical negligence as they agreed to pay $63 Million in a suit in 2010, which made similar allegations.

A Rancho Mirage woman's civil lawsuit citing fraud and elder abuse could be a "huge" step toward protecting senior citizens from potential financial scams, a consumer advocacy group says. In a complaint filed in Riverside County Superior Court last year, Lois Brown claims a Palm Desert insurance agent convinced her to buy annuities under the guise of a program benefiting low-income war veterans and their spouses, even though she wasn't qualified. Rarely do victims of elder abuse pursue litigation against suspected scammers, said Prescott Cole

Abuse of the elderly not only includes physical and emotional harm but, quite often, aging Californians fall prey to financial scams.  It is through the civil justices system and lawsuits like this one that laws are enforced to protect senior adults.

This is the kind of treatment of the the elderly that is just appalling.  Fortunately for most elder persons, the vast majority of home health care workers are competent and caring.  Unfortunately, there are some like these who simply do not provide anything close to compassionate or competent care.  If you have an elderly parent or relative that is currently under the care of a home worker, it is a good idea to install these types of cameras in the home where the care is taking place to monitor what is going on.  Hopefully, you will not find similar conduct but, if you do, filing a civil claim for damages becomes more feasible with hard, video evidence like this.

California has many laws on the books that are meant to protect elderly patients in full time care facilities.  Unfortunately, some of these provisions of law provide for more remedies than others.  Such was the case in this decision which limited the damages in the civil action brought by the daughter of an alleged abused elderly mom.

Under California Health and Safety Code 1430(b), a violation of the Bill of Rights for elderly patients in skilled and intermediate nursing care facilities can arise a cause of action for monetary damages, injunctive relief, attorney’s fees and costs.  The statute reads, in pertinent part, as follows:


“A current or former resident or patient of a skilled nursing facility, as defined in subdivision (c) of Section 1250, or intermediate care facility, as defined in subdivision (d) of Section 1250, may bring a civil action against the licensee of a facility who violates any rights of the resident or patient … The licensee shall be liable for the acts of the licensee’s employees. … (c) The remedies specified in this section shall be in addition to any other remedy provided by law.”
The importance of consulting and retaining a California elder abuse lawyer familiar with the legal rights and remedies provided to residents of care facilities:

The civil liberties spelled out in the Elder Patient’s Bill of Rights are not all inclusive and legal recourse for older persons who have been subjected to mental, physical, or financial abuse at the hands of their caretakers are certainly not limited to those spelled out in Cal. H&S Code 1430.  These types of claims require investigating promptly, securing the proper evidence of abuse or neglect, and presenting the claim in a timely manner under proper legal protocols and procedures.  Consulting an attorney familiar with these types of claims is essential to a proper representation of the patient and zealous advocacy to not only compensate the victim but, prevent future conduct that harms vulnerable Californians.
