Family of crash victim sues City of Los Angeles over 'dangerous' curve on Sunset Boulevard

Family of crash victim sues City of Los Angeles over 'dangerous' curve on Sunset Boulevard | California Car Accident and Injury Attorney News | Scoop.it
The family of a woman killed in a head-on collision on Sunset Boulevard in Westwood are suing the other driver as well as the city of Los Angeles, alleging officials were aware of previous accidents on the dangerous curve where the crash occurred.
Steven M. Sweat's insight:

Songs have been written about it dating back decades.  The infamous "dead man's curve" on Sunset Boulevard in Los Angeles. Now, the family of a woman who was killed coming around this bend on this major L.A. thoroughfare is suing both the driver that hit her and the City of Los Angeles alleging that the curve constitutes a "dangerous condition".  California law defines a "dangerous condition of public property" as a "condition ... that creates a substantial risk of injury to members of the general public when the property [or adjacent property] is used with reasonable care and in a reasonably foreseeable manner."  See California Government Code 830(a). These types of claims usually require showing that the public entity was on notice due to prior accidents and that they had not acted reasonable in trying to repair or improve the area in question despite being on notice.

Steven M. Sweat's insight:

The 405 freeway through Orange County including Huntington Beach is one of the most heavily trafficked thoroughfares in the U.S.  Millions of cars each year travel this stretch of roadway.  With 6 or more lanes of travel in either direction at certain junctures, It only takes a split second and misjudgment for a vehicle to cause this type of chain reaction, multi-car accident.  The lesson here is to travel at a safe speed and distance.

Nissan, BMW Recall 94,000 Cars for Stalling Issues

Nissan, BMW Recall 94,000 Cars for Stalling Issues | California Car Accident and Injury Attorney News | Scoop.it
Nissan and BMW are recalling 94,296 vehicles fitted with fuel pumps that can possibly cause the engine to stall, according to two separate filings with the National Highway Traffic Safety Administration. Both companies contacted Bosch, the fuel pump’s supplier, between March and July last year after increased warranty claims were made for 2014 and 2015 model-year […]
Steven M. Sweat's insight:

It is definitely not a safe situation when your car stalls in the middle of a busy road, highway or freeway!  Apparently, these stalls are due to faulty fuel pumps that were found to have nickel shavings in them.  If you have one of these models, it is important to take it in for the recall and not risk driving, stalling and being involved in an accident that could cause injury or death!

Illegal Immigrants File Half Million Driver's License Applications Under New CA Law

Illegal Immigrants File Half Million Driver's License Applications Under New CA Law | California Car Accident and Injury Attorney News | Scoop.it
Nearly 500,000 immigrants living illegally in California have applied for a driver’s license since the state started issuing the licenses this year, twice as many as the state’s DMV had expected by this time.
Steven M. Sweat's insight:

Under California legislation that went into effect this year, illegal immigrants can apply for a driver's permit.  As an attorney who represents car accident victims in California, I am hopeful that this will lead to more people driving with insurance in the Golden State.  Uninsured drivers are a huge problem in many parts of CA including Los Angeles and many of these drivers are also unlicensed and undocumented.

Unfortunately, 2014 going into 2015 has been a record time for recalls for automobiles in the U.S.  With all the notices, it may be tempting to just ignore them and keep driving your vehicle but, this would be a huge mistake.  Automobiles are recalled for a reason and that reason is that they contain parts that have or can cause personal injury or death.  This is a great article from Consumer Reports about how to find out if your vehicle is subject to a recall and what to do.

Bruce Jenner Files Motion to Try to Dismiss Wrongful Death Lawsuit Against Him

Bruce Jenner Files Motion to Try to Dismiss Wrongful Death Lawsuit Against Him | California Car Accident and Injury Attorney News | Scoop.it
Lawyers for Jenner say he should not have to compensate relatives of the woman killed.
Steven M. Sweat's insight:

Interesting legal maneuvering is going on in the Bruce Jenner wrongful death lawsuit.  Jenner was involved in a rear end collision in Malibu, California that resulted in the death of the driver of the vehicle he hit.  California laws of civil procedure allow a defendant being sued to file motions that allege that the facts stated in a complaint (or lawsuit) are not sufficient to state a legal cause of action.  The issue here is whether or not the plaintiff's, who are stepchildren of the decedent, were "financially dependent" upon the decedent for essential expenses.

Bruce Jenner sued for Malibu car crash that resulted in fatality

Bruce Jenner sued for Malibu car crash that resulted in fatality | California Car Accident and Injury Attorney News | Scoop.it
The stepchildren of a woman killed in the crash are suing him.
Steven M. Sweat's insight:

Bruce Jenner has been in the news quite a bit in the last few years.  Unfortunately, this is not good news for the former Olympian and reality T.V. star.  Following a crash on the Pacific Coast Highway in Malibu, CA where allegations have been made that Jenner may have been talking on a cell phone when he rear-ended a vehicle, causing a fatality, he is now being sued for wrongful death.  If the lawsuit is successful, the plaintiffs would be entitled to both the costs associated with any income the decedent was providing to support their family as well as the "economic value" of the "loss of love, comfort, society and companionship" associated with the loss of a loved one.

Steven M. Sweat's insight:

We all know the dangers of vehicle vs. vehicle collisions but, there are far too many instances of vehicles colliding into residential and commercial structures causing injury or death as well.  This is a tragic case of a vehicle going out of control and crashing into an apartment complex and killing a mother and her baby.  No doubt, speed was a factor in this incident.

You might want to increase your coverage to mitigate risks.
Steven M. Sweat's insight:

Small cars like the MINI Cooper or Fiat 500 are becoming more common on U.S. roadways especially in states like California where gas prices tend to be high.  Many people like the look and feel of a smaller vehicle as well.  However, small and mini vehicle owners should be aware of statistics which show that they are more likely to be seriously injured or killed in certain types of collisions, including front end impacts.  Planning by purchasing additional insurance that may cover medical costs is a great idea for these drivers.

Juries To Decide Landmark Cases Against Uber and Lyft to Classify Drivers as Employees Rather than Contractors

Juries To Decide Landmark Cases Against Uber and Lyft to Classify Drivers as Employees Rather than Contractors | California Car Accident and Injury Attorney News | Scoop.it
Two landmark lawsuits that claim that drivers for ride-hailing services Uber and Lyft should be considered employees rather than contractors will both go to jury trial, two U.S. judges ruled Wednesday. The decisions could have a ripple effect on the business models of the burgeoning on-demand and sharing economies. Uber and Lyft are [...]
Steven M. Sweat's insight:

I knew it was only a matter of time before this issue would be adjudicated.  As I have written in several prior blogs (see here), ride share services are attempting to avoid the normal liability associated with an employer-employee relationship.  They classify their drivers as "independent contractors" and, thereby, avoid having to pay certain types of wages and benefits but, also avoid being held liable in the event of an accident where the Uber or Lyft driver is at fault.

New red-light cameras would be banned under proposed California legislation

New red-light cameras would be banned under proposed California legislation | California Car Accident and Injury Attorney News | Scoop.it
State Assemblyman Matthew Harper (R-Huntington Beach) has introduced a bill to prohibit the installation of red-light cameras, a move that he says would improve safety and traffic flow on California streets.
Steven M. Sweat's insight:

Running red lights is a major cause of auto accidents every year in California.  However, some research indicates that installation of red light cameras may actually increase the number of rear end collision crashes due to people making sudden stops to avoid being photographed and ticketed.  The real answer for all drivers in California especially in urban areas like Los Angeles is to simply slow down when you see a stale green or yellow light and stop within a reasonable distance of the intersection for a red light.  However, human nature being what it is and traffic only getting worse in L.A. and other urban areas of the Golden State, this debate will continue!
