As an attorney that represents auto accident victims in the State of California , I'm glad to see the data on accidents involving so-called "driverless" cars being made public.  I think these types of vehicles have the potential to reduce traffic congestion and motor vehicle collisions but, Google and other manufacturers should not be allowed to "hide the ball" on the safety record of such vehicles if they are being tested on the open roads of the Golden State.

The board recommended manufacturers begin by making a warning system standard, and then add automatic emergency braking after the National Highway Traffic Safety Administration completes standards for them. Only four of 684 passenger vehicle models in 2014 included automatic braking systems as a standard feature: the Mercedes-Benz G Class 4X4, an SUV; the Subaru Forester and Outback, also SUVs, and the Subaru Legacy, a mid-sized sedan. When the systems are offered as options they are typically on high-end vehicles like Cadillac, Infiniti and Lexus models and are often bundled with non-safety features like heated seats or faux leather interiors, making the overall package more expensive. "Slow and insufficient action on the part of the (highway traffic administration) to develop performance standards for these technologies and require them in passenger and commercial vehicles, as well as a lack of incentives for manufacturers, has contributed to the ongoing and unacceptable frequency of rear-end crashes," the report said.

Should all cars sold in the U.S. have some type of collision avoidance systems in place?  While I think this is a good idea in concept, as I have pointed out in other blog posts (click here), such systems will always have their limitations and are no substitute for sound driving habits, which are the best way to avoid car crashes.

Interesting legal maneuvering is going on in the Bruce Jenner wrongful death lawsuit.  Jenner was involved in a rear end collision in Malibu, California that resulted in the death of the driver of the vehicle he hit.  California laws of civil procedure allow a defendant being sued to file motions that allege that the facts stated in a complaint (or lawsuit) are not sufficient to state a legal cause of action.  The issue here is whether or not the plaintiff's, who are stepchildren of the decedent, were "financially dependent" upon the decedent for essential expenses.

Bruce Jenner has been in the news quite a bit in the last few years.  Unfortunately, this is not good news for the former Olympian and reality T.V. star.  Following a crash on the Pacific Coast Highway in Malibu, CA where allegations have been made that Jenner may have been talking on a cell phone when he rear-ended a vehicle, causing a fatality, he is now being sued for wrongful death.  If the lawsuit is successful, the plaintiffs would be entitled to both the costs associated with any income the decedent was providing to support their family as well as the "economic value" of the "loss of love, comfort, society and companionship" associated with the loss of a loved one.

We all know the dangers of vehicle vs. vehicle collisions but, there are far too many instances of vehicles colliding into residential and commercial structures causing injury or death as well.  This is a tragic case of a vehicle going out of control and crashing into an apartment complex and killing a mother and her baby.  No doubt, speed was a factor in this incident.

The lesson here is simple: Slow down and stop at controlled intersections!  Speed is a primary factor in so many auto accidents in Los Angeles and throughout the U.S. This particular case resulted in a death and an arrest.  The most likely charge will be vehicular manslaughter for gross and reckless conduct behind the wheel.

[...] observers seized on the ruling as a possible game changer for Uber, as well as rivals like Lyft and other on-demand companies like Postmates and Handy, which all rely on vast workforces of independent contractors. “If the court's view holds up under appeal, this is a very significant decision, not just for Uber and Lyft, but for a range of other new platforms like Instacart that rely on the on-demand workforce,” said Arun Sundararajan, an NYU business professor who studies the emerging sector. [...] the ruling could stifle innovation, according to Sundararajan. Uber is “in the business to provide transportation service to passengers,” it wrote. [...] Uber “is involved in every aspect of the operation,” the ruling said, including setting rates for rides, vetting drivers and more. A raft of lawsuits now winding their way through the courts seek to have drivers and other on-demand workers reclassified as employees, but those are years away from final decisions. [...] it is contrary to a previous ruling by the same commission, which concluded in 2012 that the driver ‘performed services as an independent contractor, and not as a bona fide employee.’ [...] the debate could spur creation of a new employment model rather than the current black-and-white choices of W-2 full-time employment or 1099 independent contract work. Sundararajan had a similar view, saying the case underscores the need “to create a new social safety net as employment is unbundled and our workforce becomes largely freelance.”

While this ruling is limited to the context of wages for the drivers of ride share services like "Uber" and "Lyft", it may have broader implications for auto accident victims traveling in ride-share vehicles.  If the driver is an employee, then the normal laws of negligence and "respondeat superior" would apply to hold Uber and other ride share companies liable for acts performed within the scope of employment.

(Reuters) - A widow has filed a wrongful death lawsuit against Marion Suge Knight, accusing the rap mogul of carelessly striking and killing her husband with his pickup truck during a fight outside a Southern

If the allegations are true that Suge Knight intentionally ran over a person with his truck after an argument, I think a civil judgment against him may be likely.  However, trying to hold Ice Cube and Dr. Dre and their production company liable, will be a much tougher legal battle.  The argument made in the lawsuit is that the meeting where the incident took place was set up by the production company.  It will probably have to be proven that the officials were acting on behalf of the production company and that they knew or should have known that this type of incident was likely or at least probable.  We will continue to monitor and follow this case.

The family of a woman killed in a head-on collision on Sunset Boulevard in Westwood are suing the other driver as well as the city of Los Angeles, alleging officials were aware of previous accidents on the dangerous curve where the crash occurred.

Songs have been written about it dating back decades.  The infamous "dead man's curve" on Sunset Boulevard in Los Angeles. Now, the family of a woman who was killed coming around this bend on this major L.A. thoroughfare is suing both the driver that hit her and the City of Los Angeles alleging that the curve constitutes a "dangerous condition".  California law defines a "dangerous condition of public property" as a "condition ... that creates a substantial risk of injury to members of the general public when the property [or adjacent property] is used with reasonable care and in a reasonably foreseeable manner."  See California Government Code 830(a). These types of claims usually require showing that the public entity was on notice due to prior accidents and that they had not acted reasonable in trying to repair or improve the area in question despite being on notice.

The 405 freeway through Orange County including Huntington Beach is one of the most heavily trafficked thoroughfares in the U.S.  Millions of cars each year travel this stretch of roadway.  With 6 or more lanes of travel in either direction at certain junctures, It only takes a split second and misjudgment for a vehicle to cause this type of chain reaction, multi-car accident.  The lesson here is to travel at a safe speed and distance.

It is definitely not a safe situation when your car stalls in the middle of a busy road, highway or freeway!  Apparently, these stalls are due to faulty fuel pumps that were found to have nickel shavings in them.  If you have one of these models, it is important to take it in for the recall and not risk driving, stalling and being involved in an accident that could cause injury or death!

Under California legislation that went into effect this year, illegal immigrants can apply for a driver's permit.  As an attorney who represents car accident victims in California, I am hopeful that this will lead to more people driving with insurance in the Golden State.  Uninsured drivers are a huge problem in many parts of CA including Los Angeles and many of these drivers are also unlicensed and undocumented.
