A motorsport professional who attended Paul Walker's charity car show and toy drive on Saturday tells The Hollywood Reporter the drive that would be the star's last had an innocent beginning.

As an attorney in Los Angeles that has represented thousands of car accident victims over the years, I have seen a fair amount of car crashes caused by mechanical failure.  However, from the photographs of this incident, I have to say that this vehicle had to be going at a significant rate of speed to crash as severely as it did, which obviously led to the tragic death of the occupants including Paul Walker.  Speed is a factor in many surface street and freeway smash ups like this one every year in California.  It will be interesting to see what the findings of the crash scene investigation reveal.

As an auto accident lawyer practicing in Los Angeles, I can't tell you the number of times that I have seen distracted driving cause or contribute to a traffic collision.  This sign perfectly illustrates the concept that the human mind is only able to concentrate so well with multiple stimuli.  When you are behind the wheel, concentrate on the road and put the cell phone down.  You could save a life!

Online ride-sharing companies will provide more insurance for drivers under a law signed Wednesday by Gov. Jerry Brown, capping a year of intense wrangling between the nascent industry and lawmakers.
Steven M. Sweat's insight:

After much "wrangling" between ride share companies and the California state legislature, new laws related to insurance for drivers employed by "Uber", "Lyft" and "Sidecar" were agreed to and will go into effect next July.  Currently, ride share companies are required to carry $1Million in supplemental coverage above and beyond what the driver carries.  The debate was whether this should be required when drivers had their app on and were waiting to pick up passengers but, didn't actually have a passenger in their vehicle.  The debate became heated earlier this year when a driver struck and killed a little girl in San Francisco and Uber tried to deny liability because the driver was not actually carrying a passenger at the time of the collision.  The new law will require that the companies insure individual drivers even when they aren't carrying a passenger but, only up to the limit of $50,000 per claimant and $100,000 per accident.  As an attorney who represents injury victims in California, I think that ride share drivers should be treated like any other agent or employee of a company and that the ride share companies (as the "employers") should be held fully accountable for personal injury or wrongful death but, we will have to see how this eventually plays out.

How do you insure a self driving car for accidents?  What if the car computer gets hacked?  What if the owner fails to update the software running the vehicle?  What if there is a malfunction?  Who is legally responsible for personal injuries or property damage caused by one of these vehicles?  These are the types of difficult issues now facing the California legislature.  California has become one of the few states to allow these autonomous vehicles and will need to decide these issues.

Corporations (much like governmental entities) sometimes become places where change is slow.  The larger a corporate entity like General Motors, the worse the problem.  Unfortunately, when you are manufacturing a product that is capable of killing people, a slow reaction to safety issues is not a good thing!

The City of Glendale, CA has seen a spike in pedestrian mishaps in the last several years.  As this public safety campaign tries to highlight, many of these incidents are the result of people being distracted by cell phones and other electronic devices.  It only takes a split second to take your eyes off the road and run over a person in the street.  SLOW DOWN and keep your hands on the wheel and your eyes on the road!

When does gross recklessness go from being negligent to being criminal?  When someone gets behind the wheel after being forbidden to do so due to a medical condition which causes him or her to be unable to safely operate a motor vehicle this can and should be charged as a crime.  In addition, it shows a reckless disregard for the safety of other drivers and would entitle the plaintiff's to punitive damages in addition to compensation for their injuries.

Well, like it or not, so called "driverless cars" are now a reality on our California roads and freeways.  As a car accident attorney practicing in the urban streets of Los Angeles, I am still skeptical of the safety and insurance issues involved with these cars.  I guess only time will tell if these vehicles are involved in traffic collisions as to who will be legally responsible for personal injury, wrongful death or property damages associated with "driverless crash".

Interesting data here showing the so-called "ban" on cell phone use not reducing car crashes in California.  I think the problem is that the restrictions allow for drivers to dial numbers by hand and text to talk (at least for adults) and, therefore, the "exceptions swallow up the rule".  As an attorney that handles auto accident claims in the Golden State, I can say that I continue to see traffic collisions caused by cell phone use on a regular basis since the laws were enacted by the California legislature.

The California Public Utilities Commission wants the insurance industry to get off its duff and start creating some products to offer to ridesharing driver

The ride sharing phenomenon is apparently out ahead of rules necessary to protect consumers according to the California Public Utilities Commission. Ride sharing companies like Uber and Lyft operate by allowing drivers to pick up passengers through a request on a phone app.  California has already become the first state in the nation to require commercial auto insurance coverage for these carriers (known as "transportation network companies").  However, there is still a question as to whether or not the driver's personal auto insurance or the companies liability insurance policy should cover injury claims from traffic collisions that occur while the driver is "en route".  California lawmakers are trying to address this issue.
