An example alleged Intellectual Property (IP) theft in a Chinese Joint Venture (JV) between Volkswagen and FAW. Important example to support any points made in essays about one of the major threats of operating in China, particularly in JVs.

 

Fellowes Inc. the U.S. manufacturing company and one of the world's largest makers of office and personal paper shredders. This is another potential example of IP theft in JVs although possibly an example of poor planning and contracts when starting the JV.

This does strengthen the argument for keeping production in your home country including the rising wage costs, transportation and duties. If you production is labour intensive there also lots of opportunity for a Chinese company to reverse engineer your product and sell it for a great deal less. In addition to this the Chinese firm may then view your domestic market as a place to export to with its potential higher prices. Big potential risks.

A 2009 Business Week story with details on Inditex owned retail chain Zara's market entry strategy to China. Zara entered the Chinese market in 1998 long before many of its other rivals such as H&M in 2007 or other firm's like Topshop who are only recently starting to venture into the market. First mover advantage is clearly a benefit and one of the reasons for their success.

 

More on Zara: http://www.bbc.co.uk/news/19648206 Zara is a very successful clothing retailer which set up its own stores in China very early on before many of its rivals. However Zara produces most of its goods (50%) in Spain, Portugal and Morocco unlike its rival H&M which makes 75% of its products in Asia. This has allowed them to develop and produce products much quicker avoiding the lengthy lead times of off-shoring production to China. This has made them the quickest to bring out new product lines and respond to fashion trends best. This firm has managed to develop sustainable competitive advantage by pursuing both cost leadership with its efficient lean production methods e.g. JIT and differentiation with its high demand fashionable product range. A great example of a firm successfully restructuring away from difficult consumer electronics markets like smartphones; dominated by firms such as Samsung and Apple. Rather than try and compete with these giants with the high costs involved (e.g. R&D and promotion) Panasonic has decided to make other areas its core business such as high-tech parts for car manufacture and homes. This strategy appears to be paying off moving Panasonic from heavy losses to profit, but has come at very high costs in the short-term.
