"It is clear that BP, having failed in its repeated efforts to enjoin the Settlement Program after realizing that its lawyers and consultants had under-estimated the projected settlement program pay-outs by several billion dollars, is engaged in yet another bad faith attempt to significantly slow down, if not shut down, the processing and payment of legitimate claims, by distracting the claims administrator and his staff with burdensome requests while depriving the program of the administrative funds to efficiently and effectively operate," said the response motion filed by attorneys Stephen Herman and James Parkerson Roy.

FEA deternined that pressure-caused pipe displacement within the well bore, predicting both pipe deformation and resulting stresses due to buckling.   The BSR would likely have worked, except for one thing: the pipe wasn’t where it was supposed to be.

Judge blocks BP request to suspend Gulf Oil spill payments - Business - CBC News

A U.S. judge refused Friday to temporarily shut down a multibillion-dollar settlement program for compensating victims of BP's 2010 Gulf oil spill, saying he has seen no evidence of widespread fraud among the tens of thousands of claims.

BP did not foresee the amount of claims - businesses did not foresee the perceptions of the public who canceled trips and conventions to SWFL because of the Gulf Oil Crisis.  BP and their claimants have something in common - reacting to what neither could foresee. 

 

They differ in that businesses are reacting to an action  over which they had no control.  Did BP have control over actions that caused the 3 month flood of oil into the Gulf?

Perhaps they are most alike in that they are exercising an opportunity to make money- a way that was approved by BP's attorneys.  Seems if BP wants to make money, they need to file a "do-over" or  "oops" suite against those who drafted and reviewed the Claim docs that BP agreed to.

BP Economic & Health Claims....Connect the dots:  Corexit was used to dispurse oil slicks in the Gulf Oil Crisis  in 2010.  EPA & BP knew that Corexit is toxic to both humans and wildlife as the UK now does not allow its use. 

 

BP claims that the dispursements are not harmful but we need to ask the clean up crew of the Valdez incident - but since they are deceased - we cant. 

 

Corexit's use gave the false impression that the oil disappeared. In reality, the oil/Corexit mixture became less visible, yet much more toxic than the oil alone. A desire to mitigate not the damage to the environment, but the "image" of those who are responsible for the disaster was the intent.


There are many more dots to connect but the bottom line questions are:  Are Public Health and Environmental Tragedies the New Norm for Oil Spill Cleanups?   What is the future impact of the Gulf Coast Economy as time reveals the unintended consequences of choices?

A Coast Guard spokeswoman said the federal on-scene coordinator -- Capt. Duke Walker in June -- made the decision BP did not have to do the reamaining clean up. Walker was replaced in early July by Capt. Thomas Sparks.  Hmm....

 

State officials say BP also has relied on an earlier Coast Guard ruling that thousands of anchors used to hold booms in place along more than 380 miles of the state’s coastline at the height of the spill need not be recovered by BP.  They cannot account for 1,700 of these anchors that are causing damage according to the state's reports coming in from. 

 

Curiouser and curiouser...

 

I hope all business continue to place their claims before April 2014...even in SWFL where no oil hit our shores, the perceptions that it did, mucked up our area's interdependent businesses at a time when they were just getting their bearing from the real estate downturn.

 

BP's advertising is as slick as the oil that still lines parts of the gulf coast region...

Maybe Collier County needs to read this.  The people of Isle de Jean Charles have been there since 1830. They settled there after fleeing the U.S. government’s forced resettlement program.  s Chief Albert tells the story, the accelerated erosion of the Gulf coastlands dates to the early 1940s. Big oil received a license from federal, state and local authorities to build canals through the Delta marshlands in search of oil. The new canals cut every which way, often crisscrossing, in search of liquid gold. And as they did, the marsh began to disappear. The salt water of the Gulf of Mexico seeped further and further into the Delta.

When ExxonMobil’s Pegasus pipeline burst last month, filling the streets and front lawns of small-town Mayflower, Arkansas, with pools of heavy crude oil, the company followed what has by now become standard protocol: attend to the spill and clamp down on the media.

Gulf Coast communities share simliarties.  Over the last five or six years we’ve seen a lot of things effect our local economy that we had no control over, but developing a diverse economy to ensure economic growth is something that we can control.   While Alabama's economis is tied to retail sales and hospitality services, Collier's have been tied to real estate and tourism (hospitality).    Economic Development Alliance stated, "We learned with the oil spill and hurricanes, retail and hospitality are the first to suffer. While we don’t want to take anything away from those two industries, our focus is to make other areas of our economy stronger to create more balance."  So too is the path of Collier County.
