London cycling deaths spark an important debate. Los Angeles should tune in - LA Times

London cycling deaths spark an important debate. Los Angeles should tune in - LA Times | Bicycle Safety and Accident Claims in CA | Scoop.it
London is not a bicycle haven like Copenhagen or Amsterdam. But it has gone for cycling in a big way, especially since electing cycling advocate Boris Johnson mayor in 2008.
Steven M. Sweat's insight:

Cycling is becoming a greater trend in many urban areas around the world including London and here in Los Angeles.  As this L.A. Times piece points out, though, with additional people using bikes to commute to work, school and for basic transportation, comes additional risks in persons on two wheels trying to share the road with cars and trucks.  A rash of deaths recently in London has sparked this debate and has led to calls for additional safety measures on busy city streets like separated bike lanes, with dividers or at least designated lanes.  As the article points out, several of the recent deaths occurred in lanes that were marked for bikes only (similar to the green lanes that have been installed in downtown L.A.) so this is not a "end all" answer but, it does seem to curb some of the fatal and injury-causing bike crashes.  As Los Angeles continues to try to become more "bike friendly", these types of debates can and should take place here in tinsel town.

Bicycle Safety | AAA Exchange

Bicycle Safety | AAA Exchange | Bicycle Safety and Accident Claims in CA | Scoop.it
Like motorists, bicyclists follow rules and need space to safely operate in traffic. Learn more about sharing the roadways.
Steven M. Sweat's insight:

Some great tips and safety videos here from AAA about motorists and cyclists sharing the road in peace.  I love the intro:

"Cyclists are sons, daughters, mothers and fathers. By showing common courtesy and respect on the road, we can ensure the two-way street is a safe street for all."

Pretty much says it all.  California law allows bikes to use the roadway just like any other "vehicle" under the California Vehicle Code.  In addition, as of this year, new legislation has been enacted that mandates that cars, trucks and SUVs who are attempting to a pass a bicycle on the road need to provide a reasonably safe buffer recommended to be at least 3 feet of space between the bike and the automobile.  Share the road!  It's the law!

Cycle Tragedy Adds to Woes for NSA Contractors
Wall Street Journal (blog)
The document also concluded that the contractor's safety plan didn't take bike hazards into account and it noted that two other accidents occurred involving the same sign.
Steven M. Sweat's insight:

Bicyclists colliding with fixed objects like road signs or abutments are more common than one might think.  This is one example of a tragic incident near the NSA HQ where a roadway sign post was placed in such a manner as to lack good visibility.  This resulted in a collision and death of the cyclist and a wrongful death claim against the NSA.

As a bicycle accident attorney at Ehline Law Firm PC (See here: http://losangeles.ehlinelaw.com/bicycle-accidents-lawyer/) we have heard a lot of strange stories. But here, a contractor seems to have hit a new low. Under California law, the contractor would have to take safety into consideration and may also be legally liable.  We will keep you updated on this.

California bicyclists will get 3-foot buffer from passing motorists under new law

California bicyclists will get 3-foot buffer from passing motorists under new law | Bicycle Safety and Accident Claims in CA | Scoop.it
Gov. Jerry Brown announced Monday he has signed legislation requiring California drivers to stay at least 3 feet away when passing bicyclists.
Steven M. Sweat's insight:

California now follows 22 other states and D.C. in defining by motor vehicle codes what is a safe distance for passing a bicyclist.  Bicycle riding advocates have beeen trying for years to get this law passed to curb aggressive driving in and around cyclists.  The California legislature has finally heeded this call and decided that a three foot buffer is reasonable and appropriate.  The law will state, however, that when a car cannot give three feet of room to pass a bike, they may pass but, must slow down and only overtake the bike rider in a way that does not endanger their safety.

How to Avoid the Most Common Types of Bike Accidents | Road Rights | Bicycling.com | Bicycle Safety and Accident Claims in CA | Scoop.it
Your chances of getting hit by a car while cycling are smaller than you might think. Here's how to prevent the most common types of automobile-bike collisions.
Steven M. Sweat's insight:

This article does a good job of examing three of the most common bicycle accident scenarios:

  1. Blown Stop Signs
  2. The "Left Cross": Left hand turn of a motor vehicle into the oncoming path of a cyclist; and
  3. The "Right Hook": Abrubt right hand turn in front of a cyclist.

It breaks down tactics bike riders can use to avoid these collisions.  As a bike accident lawyer , I think we need more of this type of information for the bike riding public to promote cycling safety.

After Fatal Crash With Cyclists, Driver's Tweets Help Spur Murder Charge : NPR | Bicycle Safety and Accident Claims in CA | Scoop.it
An 18-year-old man in California stands accused of murder, after law enforcement officials upgraded a manslaughter charge against him, based on his tweets and driving history.
Steven M. Sweat's insight:

Is it not bad enough that you drive 85 mph in a 40 mph zone and hit and kill two cyclists in a bike lane but, then you have to brag about it on Twitter saying you went on a "death ride".  The California penal code defines "murder" as the "unlawful killing of a human being" with "malice aforethought" and the term "malice aforethought" is defined as either "deliberate intention" or when the circumstances surrounding the death show "an abandoned or malignant heart." California Penal Code section 187.  Looks like it fits the definition to me!

Steven M. Sweat's insight:

Great expose about the struggles of an urban bike commuter in Los Angeles.  It seems crazy that a city with such great biking weather is so addicted to their cars and downright hostile to bikers trying to use the streets of L.A. for travel.  Her quote pretty much sums it up:

“There is never a day when I get on my bike when I am not harassed by someone. Every single day, someone honks at me, yells at me — ‘Go to the park! Get on the sidewalk!’ That’s why we need a cultural shift in this city. Bicyclists should be accepted on the surface streets. You have to build a little fortress of strength when you go out on a bike.”

$100K awarded in wrongful-death lawsuit involving hit and run of a cyclist

$100K awarded in wrongful-death lawsuit involving hit and run of a cyclist | Bicycle Safety and Accident Claims in CA | Scoop.it
The Kruszewski family had sought $5 million in the civil lawsuit filed in June against Elias Webb, 32.
Steven M. Sweat's insight:

This tragic case out of VA is, unfortunately, far too common of a scenario nationwide, including here in California as follows:

  1.  A bicyclist is struck by a driver who then attempts to flee (i.e. a hit and run)
  2. The driver is tracked down (not always the case) but ..
  3. Has only minimal insurance coverage and no appreciable assets to compensate the victim's family

At the present time, the minimum liability coverage that any CA driver must have for bodily injury or death to another person caused by their motor vehicle is only $15,000 per claimaint and $30,000 aggregate per claim.  In this case, the coverage was actually $100,000 but, this is still a paltry sum for the value of a human life snuffed out by a reckless and careless driver who attempted to flee the scene to avoid responsibility for the bike wreck.

As an attorney that represents persons injured in bicycles in California, I am hopeful that the minimal coverage limits will be increased in the future.  Californians deserve better!

Whether you ride bikes for fun, convenience, or for fitness; you have specific legal rights if you are hit by a motor vehicle. Often, drivers assume they have the right-of-way and aren’t even looking for bicyclists in the roads. “Share the road” is the law, and in many circumstances, automobiles are required to yield to bicyclists. Did you know that motorists must leave a safe distance of at least three feet when passing cyclists in Florida?

In most bicycle accidents, a negligent automobile driver is at fault. Bicyclists colliding with motor vehicles can occur in a number of ways, some including:

Steven M. Sweat's insight:

With the new 3 foot safe distance buffer rule for motorists passing bikes in California, I think a rear view bicycle camera is a great tool to evidence violations related to mishaps.  The law is meant to provide further protection to aggressive motorists passing bikes and causing spills but, without hard evidence of a violation, these cases become "he said, she said".  Having proof via video seems like a great idea!

Jonathan Rosenfeld's curator insight, May 7, 2013 7:02 AM

While many drivers are mindful of the ‘safety space’ needed to be put between their vehicle and the vehicle in front of them, they may behave very differently when a bicyclist is located in front of them– negligently providing precious little room between their vehicle and the the bicyclist.

While rear-end bicycle collisions do take place while stopped at a traffic signal, other bicyclists are struck from behind by vehicles as they attempt to pass them or when the cyclist lawfully changes lane of travel.

California's new cycling 'three-foot rule' stirs some 'reader rage'

California's new cycling 'three-foot rule' stirs some 'reader rage' | Bicycle Safety and Accident Claims in CA | Scoop.it
On Sept. 16, 2014, California will join nearly half the states in requiring cars to keep at least a three-foot distance from bikes that they pass on the road.

Steven M. Sweat's insight:

California's enactment of legislation requiring a three foot buffer when motorist pass cyclists is stirring debate in the Golden State.  The bottom line is that bikes are considered vehicles under the California Vehicle Code and have all the same rights and responsibilities to share the road with cars, trucks and SUVs.  Allowing for some space when passing doesn't seem to be unreasonable given the aggression that many motorist show towards people riding on bikes.

Always wear protective gear like gloves, and follow the law.  But there are many other ways to avoid the devastating effects of being hit by a care while riding a bike, and other spills, if individuals take the time to learn about some of the primary factors leading to wrecks on bikes. After all, an ounce of prevention is worth a pound of cure.  And this is especially true, considering how vulnerable the human brain is when succumbing to the impact, inertia, and other ill effects of being flung into the air, and twirling head over shoulders, for example. Landing after this sudden acceleration, often racks the brain, causing it to swish around, banging into the skull, back and forth.
