Family of USU cyclist killed in slackline accident files lawsuit

Family of USU cyclist killed in slackline accident files lawsuit | Bicycle Safety and Accident Claims in CA | Scoop.it
The parents of a Utah State University student killed last year when he rode his bicycle through a slackline has filed a wrongful death and negligence lawsuit against the university and other parties
Steven M. Sweat's insight:

While bicycle collisions with fixed objects are not uncommon, this particular incident is a bit unique.  It is claimed that university students erected a "slack line" (a rope tied between two trees meant for practicing tight rope walking) and the cyclist, traveling at a high rate of speed, hit the rope and was killed.  The family is claiming wrongful death against both the students who erected the line and the University for allowing the line to be placed on campus and/or not removing it.

Is California a "bicycle-friendly" state?

Steven M. Sweat's insight:

California ranks 9th in the U.S. for being "bicycle-friendly" according to various criteria set out in this analysis by the League of American Bicyclists.  As an attorney that represents bicycle accident victims in Los Angeles, I can tell you that the City of Angels could certainly do more to improve this rating by improving upon infrastructure and education related to bicycle safety.  There are still far to many bike mishaps in "la la land", in my opinion.

Bicycle accident insurance for cyclists

Bicycle accident insurance for cyclists | Bicycle Safety and Accident Claims in CA | Scoop.it
Bicycle accident insurance can be acquired through auto accident policies or now as a separate policy of insurance to protect against damage and injury.
Steven M. Sweat's insight:

A fairly recent addition to the insurance coverage world is "bike accident insurance."  While many people who own both bikes and cars may be covered through their auto policy, people who use bicycles as a sole means of transport now have an option to be insured.

Could a "rolling stop" be Safer for Cyclists?

Could a "rolling stop" be Safer for Cyclists? | Bicycle Safety and Accident Claims in CA | Scoop.it
The fact that the law requires cyclists to come to a full stop at stop signs forces thousands of two-wheelers every day to either break the law (by treating stops like yields) or expose themselves to risk on our busy city streets by dramatically slowing down. Yet the very thing that will get bikers out of the way of cars and quickly along their ways — treating a stop sign like a yield — is against state law. In August, several hundred cyclists protested an SFPD crackdown on stop-sign rolling by obeying the letter of the law while riding home from work through the Wiggle — the path of an old creek bed that dodges some of San Francisco’s steeper hills, and connects upper Market with the lower Haight by way of Duboce, Steiner, Waller and Pierce streets. Normally the Wiggle is about a five-minute pass-through for cyclists riding from downtown to the city’s western neighborhoods. The protest stirred enough of a fuss that Supervisor John Avalos is advancing a San Francisco Right-of-Way Policy that puts pedestrians at the top of the yield chain and permits cyclists to “proceed without fully stopping at stop signs if the intersection is empty.” Bicycling in San Francisco has come a long way since the heyday of Critical Mass in the 1990s. [...] the sheer volume of cyclists has turned the monthly two-wheeled takeovers into an everyday fact of your commute. Automotive moving violations routinely get a wink and a nod — turn-signal enforcement, anyone? — creating a dangerous double standard that undermines pedestrian safety and perpetuates the scapegoating of the vast majority of conscientious bike riders in our city.

Who's responsible for death of L.A. Cyclist? | Bicycle Safety and Accident Claims in CA | Scoop.it
A delivery truck driver ran over a 19-year-old bicyclist and then drove away, a prosecutor told jurors Monday, but the defendant's attorney said another driver was likely responsible for the death.
Steven M. Sweat's insight:

Unfortunately, this bicycle accident in the Los Angeles area involves an all too common scenario: bike delivery persons getting hit and the driver fleeing the scene.  California law requires that motorist stop and provide their information after being involved in any motor vehicle collision.  Despite this legal requirement, hit and runs remain high in L.A. County.
