Is California a "bicycle-friendly" state?

Steven M. Sweat's insight:

California ranks 9th in the U.S. for being "bicycle-friendly" according to various criteria set out in this analysis by the League of American Bicyclists.  As an attorney that represents bicycle accident victims in Los Angeles, I can tell you that the City of Angels could certainly do more to improve this rating by improving upon infrastructure and education related to bicycle safety.  There are still far to many bike mishaps in "la la land", in my opinion.

Fatalities Among Cyclists Are Up: Young males not wearing helmets and under the influence are a rising majority of the death toll

Fatalities Among Cyclists Are Up: Young males not wearing helmets and under the influence are a rising majority of the death toll | Bicycle Safety and Accident Claims in CA | Scoop.it
(Reuters Health) - - The number of bicyclists killed in motor vehicle crashes on U.S.
Steven M. Sweat's insight:

The number of bicyclists involved in fatal collisions on U.S. roadways rose by 16% between 2010 and 2012, according to this report from Reuters News Service.  Unfortunately, many of the victims were young males, not wearing head gear, and cycling under the influence of alcohol.  Because California considers bikes "vehicles", it is possible to get a DUI on a bicycle and riding without a helmet is the number one contributor to significant head trauma from a crash.  This is a stark reminder to wear a helmet and not travel on two wheels after drinking!

Bicycle Traffic Collisions Are Increasing at An Alarming Rate and California Leads the Nation in Fatal Bike Accidents

Bicycle Traffic Collisions Are Increasing at An Alarming Rate and California Leads the Nation in Fatal Bike Accidents | Bicycle Safety and Accident Claims in CA | Scoop.it
If you are going to be killed by a car while riding a bicycle, there’s a good chance you are male, older than 20 and living in California or Florida.
Steven M. Sweat's insight:

"If you are going to be killed by a car while riding a bicycle, there’s a good chance you are male, older than 20 and living in California or Florida."

This is not surprising to me as a an attorney who represents bicycle accident victims throughout California .   The great thing about "warm weather states" is that you can ride a bicycle year round.  The down side is that as more cyclists take the roads, there is increased interaction with motor vehicle traffic and increased chances for crashes.  The other unfortunate thing is that a cyclist has very little protection from such a crash.  A helmet can help reduce the risk of serious head injury but, there is little else shielding the impact between the biker, the car and the ground.  This leads to many more catastrophic injuries and fatalities.  In fact, California has the highest rate of fatal bicycle collisions in the country.  These are all alarming statistics that demand to be addressed by providing further research, funding and infrastructure to increase bicycle safety and help all Californians "share the road" in peace and safety!

Can Helmet Mounted Cameras on Bike Helmets Cause Injury?

Can Helmet Mounted Cameras on Bike Helmets Cause Injury? | Bicycle Safety and Accident Claims in CA | Scoop.it
Can Helmet Mounted Cameras Cause Injury?
Steven M. Sweat's insight:

Interesting discussion here on the safety effects of helmet mounted cameras for cycling head gear.  One of the most popular brands is "GoPRO", whose representatives deny that the mounted helmet could in any way lessen the safety of a helmet even after a high impact. It will be interesting to see if additional studies are done into this issue and whether camera manufacturers will begin providing warning labels if it is found that the camera and mount can cause the helmet to split open or make head trauma more likely.

an article by RI Bike Accident lawyer David Slepkow 401-437-1100
excerpt:

In an important motorcycle and car accident cause of action decision, The Rhode Island Supreme Court reversed a “Summary Judgment” decision of the Providence Superior Court in favor of the Defendant and sent the case to a jury trial on the merits.

The  Motion Justice previously determined that no reasonable jury could believe that this bike crash was anything else but a garden variety rear-ender accident and the claims by Plaintiff’s injury attorney were speculation. The motion justice believed that the biker rear ended the automobile and therefore under RI law the cyclist was prima facie liable for the crash and entitled to no compensation as a result of the collision.

In a nutshell, the RI Supreme Court determined that there were IN FACT factual issues concerning whether the auto-bike mishap was a rear-ender and therefore an extreme remedy such as a summary judgment was not warranted and our system of justice required a jury to sort out what occurred.

This is a dramatic example of what can happen while crossing an intersection on a bicycle.  Statistically speaking, you are more likely to get into a bike accident in or near an intersection in an urban environment than just about any other place.  Thankfully, this cyclist survived the ordeal but, it is a cautionary tale for us all to be extremely cautious in traversing intersections on two wheels!

The federal government is launching an initiative to reduce the number of bicyclists and pedestrians who are killed in traffic accidents, the Department of Transportation announced on Tuesday.
Steven M. Sweat's insight:

While car crash fatalities, on the whole, are stable or going down in most states, there is a disturbing trend of an increase in fatalities in bicycle and pedestrian accidents since 2009.  This is prompting the U.S. Department of Transportation to take further measures to study the problem and find solutions.

Steven M. Sweat's insight:
Unfortunately, motorist negativity (and even downright hatred) towards cyclists is not uncommon in California and throughout the country. You don't expect this from law enforcement officials, though. As an attorney and advocate for bicyclists in Southern California, I can't say I'm surprised. I constantly see police officials placing blame for traffic collisions between motor vehicles and bikes without any legal justification and consistently ignoring the rule of law in CA which allows bikes to share the road with motorists. This is despicable conduct on the part of a person sworn to uphold this law and to protect all citizens of a SoCal city including those who choose to get out and ride their bicycle in compliance with the law!

Homeless ex-con on bike hits car door that's suddenly opened State Farm Offers $44K and Jury Renders a Verdict of almost $86K | Bicycle Safety and Accident Claims in CA | Scoop.it
Jury Verdict Alert is a news service for civil verdicts awarded in the state and federal courts of California.
Steven M. Sweat's insight:

Interesting verdict here out of Santa Barbara California.  A bicyclist hit a car door suddenly opened by a motorist and sustained a clavicle fracture and a torn meniscus requiring surgical repair.  The injured party just so happened to be homeless and had a criminal records.  Oftentimes, this type of background leads to lower offers by insurance carriers as they feel jurors will not be inclined to award big money damages.  In this case, the offer was well below even the medical costs (which were in dispute).  The jury came back with a verdict that exceeded the "best and final offer" of the insurance carrier (State Farm Auto Insurance) by almost double.

Sharing the roads in L.A. Has Proponents and Opponents

Sharing the roads in L.A. Has Proponents and Opponents | Bicycle Safety and Accident Claims in CA | Scoop.it
Motorists unite! An advisory initiative on San Francisco's November ballot urges city leaders to reverse their public transit and bicycle-friendly policies. Because 79% of households in the city have a car, proponents argue, wouldn't it make more sense to dedicate more money to helping cars move faster and making it easier and cheaper to park them? Why have local transportation authorities created a “war on motorists” by removing street parking and traffic lanes for bike routes, while hiking meter rates and parking ticket fines? Enough already!
Steven M. Sweat's insight:

In an urban environment like Los Angeles, where the car has been "king" for many decades, it is hard to push for better infrastructure for cyclists without "push back" from motorists.

PEDESTRIAN ACCIDENT IN RI

Sadly, pedestrian* accidents in Rhode Island are often fatal. The most common types of pedestrian accidents are cars running over a person travelling on foot although there are many instances of trucks, motorcycles, vans or even bicycles hitting.
