Is California a "bicycle-friendly" state?

Steven M. Sweat's insight:

California ranks 9th in the U.S. for being "bicycle-friendly" according to various criteria set out in this analysis by the League of American Bicyclists.  As an attorney that represents bicycle accident victims in Los Angeles, I can tell you that the City of Angels could certainly do more to improve this rating by improving upon infrastructure and education related to bicycle safety.  There are still far to many bike mishaps in "la la land", in my opinion.

Can Helmet Mounted Cameras on Bike Helmets Cause Injury?

Can Helmet Mounted Cameras on Bike Helmets Cause Injury? | Bicycle Safety and Accident Claims in CA | Scoop.it
Can Helmet Mounted Cameras Cause Injury?
Steven M. Sweat's insight:

Interesting discussion here on the safety effects of helmet mounted cameras for cycling head gear.  One of the most popular brands is "GoPRO", whose representatives deny that the mounted helmet could in any way lessen the safety of a helmet even after a high impact. It will be interesting to see if additional studies are done into this issue and whether camera manufacturers will begin providing warning labels if it is found that the camera and mount can cause the helmet to split open or make head trauma more likely.

an article by RI Bike Accident lawyer David Slepkow 401-437-1100
excerpt:

In an important motorcycle and car accident cause of action decision, The Rhode Island Supreme Court reversed a “Summary Judgment” decision of the Providence Superior Court in favor of the Defendant and sent the case to a jury trial on the merits.

The  Motion Justice previously determined that no reasonable jury could believe that this bike crash was anything else but a garden variety rear-ender accident and the claims by Plaintiff’s injury attorney were speculation. The motion justice believed that the biker rear ended the automobile and therefore under RI law the cyclist was prima facie liable for the crash and entitled to no compensation as a result of the collision.

In a nutshell, the RI Supreme Court determined that there were IN FACT factual issues concerning whether the auto-bike mishap was a rear-ender and therefore an extreme remedy such as a summary judgment was not warranted and our system of justice required a jury to sort out what occurred.

Novato, others settle lawsuit over girl killed by SUV while riding her bike home from school

Novato, others settle lawsuit over girl killed by SUV while riding her bike home from school | Bicycle Safety and Accident Claims in CA | Scoop.it
The city of Novato and other defendants have settled a lawsuit by the family of Hailey Ratliff, 12, who was struck and killed by a vehicle while riding her bicycle home from school on Novato Boulevard in September 2012.
Steven M. Sweat's insight:

While no amount of money can ever bring back a child, this settlement will hopefully provide some financial resources to the family and encourage the City of Novato to take further measures to make their streets safer for cyclists.

LiveLeak.com - Luckiest cyclist in Russia and quite possibly the world

he was just crossing the road then this guardian angel saved him
Steven M. Sweat's insight:

This is a dramatic example of what can happen while crossing an intersection on a bicycle.  Statistically speaking, you are more likely to get into a bike accident in or near an intersection in an urban environment than just about any other place.  Thankfully, this cyclist survived the ordeal but, it is a cautionary tale for us all to be extremely cautious in traversing intersections on two wheels!

Feds move to reduce bicycle and pedestrian deaths

Feds move to reduce bicycle and pedestrian deaths | Bicycle Safety and Accident Claims in CA | Scoop.it
The federal government is launching an initiative to reduce the number of bicyclists and pedestrians who are killed in traffic accidents, the Department of Transportation announced on Tuesday.
Steven M. Sweat's insight:

While car crash fatalities, on the whole, are stable or going down in most states, there is a disturbing trend of an increase in fatalities in bicycle and pedestrian accidents since 2009.  This is prompting the U.S. Department of Transportation to take further measures to study the problem and find solutions.

Reserve Officer on Leave After Video Where She Says She Hates All Bicyclists and Wishes They Were Dead | Bicycle Safety and Accident Claims in CA | Scoop.it
A Santa Paula police volunteer officer has been placed on administrative leave after a video posted to her YouTube page of her talking about hating bicyclists was widely criticized on the Department’s...
Steven M. Sweat's insight:
Unfortunately, motorist negativity (and even downright hatred) towards cyclists is not uncommon in California and throughout the country. You don't expect this from law enforcement officials, though. As an attorney and advocate for bicyclists in Southern California, I can't say I'm surprised. I constantly see police officials placing blame for traffic collisions between motor vehicles and bikes without any legal justification and consistently ignoring the rule of law in CA which allows bikes to share the road with motorists. This is despicable conduct on the part of a person sworn to uphold this law and to protect all citizens of a SoCal city including those who choose to get out and ride their bicycle in compliance with the law!

Cycling Doesn't Cause Male Infertility: Study - eMedicineHealth

Cycling Doesn't Cause Male Infertility: Study - eMedicineHealth | Bicycle Safety and Accident Claims in CA | Scoop.it
Cycling doesn't lead to male infertility and erectile dysfunction, but it may raise prostate cancer risk in cyclists over 50, a new study finds.
Steven M. Sweat's insight:

Nice to know that, at least by some recent medical research, male infertility and erectile dysfunction are not caused by cycling.  Nevertheless, male cyclists should take heed at a higher risk of prostate cancer (in older males).

Stop Hit-and-Runs in California Now!

Stop Hit-and-Runs in California Now! | Bicycle Safety and Accident Claims in CA | Scoop.it
In the City of Los Angeles, Angelenos have a greater than 1 in 1,000 chance of being injured or killed in a hit-and-run every year.

Los Angeles is at the center of a larger statewide problem that needs to be addressed throughout California.

Sign this petition to show your support for stopping hit-and-runs in California!
Steven M. Sweat's insight:

Hit and runs have become a problem of epidemic proportions throughout California but, especially in our major urban areas like Los Angeles.  As an attorney who represents hit and run victims in L.A., I have seen first hand the type of devastation this type of traffic collision can cause and how difficult it is to bring the perpetrator to justice.  This petition supporting additional legislation that will help track hit and run accidents and speed up the investigation of these incidents is something I fully support. If you do as well, please sign to let our CA legislators know.

Steven M. Sweat's insight:

This is a great checklist and resource on safe cycling.  It provides everything from equipment check reminders to safe cycling practices in and around traffic.  As a bicycle accident attorney with experience in representing cycling accident victims, I think that more bikers should go through these types of protocols prior to jumping on and riding.  It can reduce the number of injury and fatal accidents.

Sharing the roads in L.A. Has Proponents and Opponents

Sharing the roads in L.A. Has Proponents and Opponents | Bicycle Safety and Accident Claims in CA | Scoop.it
Motorists unite! An advisory initiative on San Francisco's November ballot urges city leaders to reverse their public transit and bicycle-friendly policies. Because 79% of households in the city have a car, proponents argue, wouldn't it make more sense to dedicate more money to helping cars move faster and making it easier and cheaper to park them? Why have local transportation authorities created a “war on motorists” by removing street parking and traffic lanes for bike routes, while hiking meter rates and parking ticket fines? Enough already!
Steven M. Sweat's insight:

In an urban environment like Los Angeles, where the car has been "king" for many decades, it is hard to push for better infrastructure for cyclists without "push back" from motorists.

Steven M. Sweat's insight:

The bicycle helmet is the single most important piece of safety equipment for the rider. Head trauma leads to more serious and life altering injuries than just about any other type of physical harm suffered from a bike crash.  It is important to make sure you have approved and certified head gear and that it is not subject to recall.

Stop hating on cyclists - An essay from "The Week"

Stop hating on cyclists - An essay from "The Week" | Bicycle Safety and Accident Claims in CA | Scoop.it
Urban cyclists have become fodder for the tabloids. It's time to separate fact from fiction.
Steven M. Sweat's insight:

The recent incident in Central Park shows the sometimes precarious interaction between bikes and pedestrians and other traffic in urban areas.  This is an essay as to the travails of cyclists and the "cyclist haters" following the incident.  It mirrors similar problems in many urban environments including Los Angeles.

Bicycling Can Be Deadlier in L.A. Than in Mumbai, Shanghai and Other Heavy-Traffic Cities (VIDEO) | Bicycle Safety and Accident Claims in CA | Scoop.it
At first, riding a bicycle through Mumbai seemed like a death wish. I saw lines of cars, scooters, rickshaws, horses, oxen, and even human-pulled carts lurch into intersections before the light turned green. I hesitated at the crosswalk, holding up traffic and setting off honking from behind. I was petrified...
Steven M. Sweat's insight:

Los Angeles, on the surface, seems like the perfect place to get out and ride a bike.  The weather is temperate and the streets seem to be wide enough in most places and more bicycle lanes and other bike-friendly features are popping up.  This study by LA Weekly shows, though, that L.A. can be deadly for cyclists.  The death count for the year so far stands at 39!

Examining statistics on bicycle accidents can help us all learn the major causes of such mishaps and educate ourselves and our families and communities on ways to prevent such incidents.  This stat sheet from the Centers for Disease Control (CDC) shows that children and adolescents are much more likely to be involved in a bike crash and parents should keep this in mind when talking to kids and demanding that they wear safety gear like bike helmets.

What Happened to Head Injuries in Bike-Share Cities? - Boston Magazine

What Happened to Head Injuries in Bike-Share Cities? - Boston Magazine | Bicycle Safety and Accident Claims in CA | Scoop.it
Overall, head injuries went down in cities like Boston that implemented bike-share programs, but a new study created confusing headlines.
Steven M. Sweat's insight:

Both good news and bad on the studies conducted related to head injuries in cities that have implemented bike-sharing programs.  While head injuries as a proportion of bodily harm for bikers went up, the total number of bicycle related injuries actually declined.  As an attorney that has represented bicycle accident victims with severe head injuries, I still feel that bike-sharing programs ought to provide helmets for their riders or mandate that riders using a bike-share cycle use a helmet.
