Is California a "bicycle-friendly" state?

Steven M. Sweat's insight:

California ranks 9th in the U.S. for being "bicycle-friendly" according to various criteria set out in this analysis by the League of American Bicyclists.  As an attorney that represents bicycle accident victims in Los Angeles, I can tell you that the City of Angels could certainly do more to improve this rating by improving upon infrastructure and education related to bicycle safety.  There are still far to many bike mishaps in "la la land", in my opinion.

Let's face it, people living in and around Los Angeles LOVE their cars.  Estimating that over half of them will start using alternative forms of transportation like bikes is probably a bit ambitious.  I am hopeful, though, that this will encourage bicycle use in and around L.A. and remind us all to stay safe and share the road bicycles to reduce the number of bike crashes involving injury or death.

Unfortunately, even the "rich and famous" are not immune to bicycle crashes.  Bono had a major collision on his bike in Central Park in N.Y. resulting in a compound fracture to his humerus.  This may result in him not being able to perform or be limited in the future.  It is a stark warning to all of us how devastating a bike crash can be and how much it can affect the rest of your life!  Our best wishes to him in his recovery.

The number of bicyclists involved in fatal collisions on U.S. roadways rose by 16% between 2010 and 2012, according to this report from Reuters News Service.  Unfortunately, many of the victims were young males, not wearing head gear, and cycling under the influence of alcohol.  Because California considers bikes "vehicles", it is possible to get a DUI on a bicycle and riding without a helmet is the number one contributor to significant head trauma from a crash.  This is a stark reminder to wear a helmet and not travel on two wheels after drinking!

The reason is there’s simply more biking,” Williams told Reuters Health. “It’s an urban phenomenon involving mostly adult males, and it’s a huge change from when mostly children were killed as bicyclists.”


“Bicycling is widely encouraged for health and environmental benefits. This study suggests we need to pay more attention to protect bicyclists when they’re out there on the road with motor vehicles,” he said.


Williams examined bicycle deaths from 2010 to 2012 as reported to the Insurance Institute for Highway Safety’s Fatality Analysis Reporting System. Bicyclists killed in motor vehicle crashes rose from 621 in 2010 to 722 in 2012, his study found.


While bike deaths shot up 16 percent, vehicle fatalities increased just 1 percent, the report says.


Despite the increase, the number of people dying in bike accidents remains among the lowest since 1975, when 1,003 cyclists died in the first year the data was compiled.


Since then, the demographic profile of bike crash victims has changed. In 1975, only 21 percent of bicyclists who died were adults, compared to 84 percent in 2012, the study found.


The researchers also found that nearly three-quarters of bicyclists killed in 2012 were adult males.


Most of the deaths were in urban areas, and 54 percent occurred in six states – California, Florida, Illinois, New York, Michigan and Texas. The proportion of deaths in urban areas rose from 50 percent in 1975 to 69 percent in 2012, the report says.

While this is a story from an urban cyclist in Portland, it could just as well be Los Angeles or anywhere else where bikes and cars compete for roadway.  In California, the law clearly states that a bicycle is a "vehicle" with all the same rights to use the roadway as a motor vehicle (See Cal. Vehicle Code Section 21200). Unfortunately, the general public is of the opinion that bikes should remain either in bike lanes (which there are far too few of in L.A.) or on the sidewalk (despite the fact that riding a bike on a sidewalk is illegal in many municipalities in and around Southern California).  It is important that all cyclists do their part to educate others on the right of bike riders to "Share the Road"!

A proposed law that would make California the first state in the country to require that adult bike riders wear helmets has reignited a decades-long debate between regulators and the bicycling community over safety.

The State of California is considering passing legislation to mandate helmet use by adults riding bicycles.  Riders who fail to comply would face fines and citations.  If passed, CA would be the first state in the U.S. to require head gear for cyclists.  Some bicycle advocates in the Golden State say that this will discourage bicycle use by making it seem "more dangerous."  As an attorney that represents bicycle riders who have been injured or killed as a result of crashes with motor vehicles, I personally think mandatory helmet use would be a good thing that could reduce serious injury or death.  Head trauma is the number one cause of catastrophic bodily harm and fatalities related to bike crashes.

It is a positive sign that across the U.S. fatal traffic collisions involving persons riding bikes and pedestrians is either stable to decreasing.  Unfortunately, as this study points out, such is not the case in San Francisco where pedestrian and cyclist fatalities are on the rise.

For cyclists who are hit, a major frustration is how infrequently drivers are caught. The Los Angeles Police Department closed one in five hit-and-runs from 2008 to 2012, meaning about 80% were unresolved, according to data the department reported last year to the Board of Police Commissioners. Less than half of those cases were closed through an arrest.


The chance of being convicted is so slim that "if you wanted to murder someone, it would almost be better to just hit them with your car," said Assemblyman Mike Gatto (D-Los Angeles), who has pushed for stiffer hit-and-run penalties.


Traffic investigators say that they are faced with thousands of hit-and-run collisions a year involving bikes, cars and pedestrians, and they must focus on cases with strong leads, such as eyewitness reports or the car's license plate number, and on crashes that kill or maim the victims.


"There are a lot of cases where we don't have a lot to go on," said Sgt. Daniel Dail, who works in the Sheriff's Department's traffic services detail.


Six days after the crash, Livingston awoke in the intensive care unit at Cedars-Sinai Medical Center. He had been in a medically induced coma while surgeons raced to stop his internal bleeding. Eight vertebrae were fractured. His pelvis was sheared in half.

Kept awake by pain, he hallucinated that he was riding his bike. "I was so scared, and in so much pain," Livingston said.

Interesting verdict here out of Santa Barbara California.  A bicyclist hit a car door suddenly opened by a motorist and sustained a clavicle fracture and a torn meniscus requiring surgical repair.  The injured party just so happened to be homeless and had a criminal records.  Oftentimes, this type of background leads to lower offers by insurance carriers as they feel jurors will not be inclined to award big money damages.  In this case, the offer was well below even the medical costs (which were in dispute).  The jury came back with a verdict that exceeded the "best and final offer" of the insurance carrier (State Farm Auto Insurance) by almost double.
