Press Release: Coca Cola Sued by Chilean artist Alejandro Escribano for Art Plagiarism

Los Angeles, Chile. – February 23, 2015. A lawsuit filed by the well-known artist Alejandro Escribano (link to web page) is winding its way through Chilean courts. At issue is Coca Cola’s appropriation and use of Escribano’s nationally-famous mural Blue Fish (Pez Azul).

This public art mural was commissioned and created by Alejandro Escribano in 2007, who registered the image with the Chilean agency of Intellectual Property Rights. Blue Fish was tragically destroyed by the 2010 tsunami in Chile, which also took the lives of many people and destroyed the town of Dichato, where Escribano lived.

 

After the tsunami, Coca Cola erected a sign on the original site of the mural, using a reproduction of the image of the original 8 meters high by 15 meters wide mural to advertise and promote their products.

“I was hugely surprised and deeply disappointed to see how Blue Fish was being used for profit,” said Escribano, an abstract painter and muralist whose work has been exhibited in the United States, Europe and Latin America. Despite the fact that photographs of the mural include the artist’s name, “Coca Cola never asked for permission nor mentioned my name or authorship in their propaganda that used the image of Blue Fish.”

 

The complaint against Coca Cola was presented in 2014 to the Public Prosecutor in District of Tome, which ordered an investigation by the police. Next March 10th is the first hearing where Escribano and his lawyer and Coca Cola representatives meet before the Public Prosecutor to discuss the case.

Nos preguntamos a menudo si es vàlido exhibir de forma virtual. Es una pràctica comùn en USA. Los que estamos habituados a las muestras de artes visuales tradicionales nos hemos quedado fijos en el viejo mecanismo del proceso creativo que involucra a tres entes: obra-artista-espectador. Para que este triàngulo tenga comunicaciòn o para que funcione el proceso creativo es indispensable este contacto fìsico. La exhibiciòn virtual nos lleva a otro plano ficticio, no tenemos fìsicamente la obra de arte y quizàs vemos al creador como un fantasma o un ser colectivo o anònimo. Si bien una exposiciòn virtual de obras puede ser muy masiva aùn para mì carece de ese contacto que necesitamos como seres humanos. En la prehistoria los primeros atisbos de sentimientos creativos fueron marcas en las cavernas, luego imitaciones del mundo aparente. Estar frente a una obra virtual es un salto tan inmenso en el aspecto sensorial que todavìa no sè como abordarlo. Como artista visual veo o considero las competiciones o exhibiciones virtuales como algo màs ficticio que nuestra propia existencia.

Press Release: Coca Cola Sued by Chilean artist Alejandro Escribano for Art Plagiarism.

We wish to report a criminal complaint filed by plagiarism against Coca-Cola Company. This is the exact reproduction of a painting mural that was destroyed by the tsunami of February 27, 2010 in the town of Dichato, Chile. The mural was duly registered with the Department of Intellectual Rights Dibam 2012. The lawsuit, filed in 2014, was admitted to processing and an order to investigate the Brigade Police Crime Investigation Tome emanated by the Local Prosecutor of that Commune. Next March 10, 2015 will be the first hearing took between artist Alejandro Escribano and his counsel and offended and representatives of Coca-Cola suspicion of plagiarism. The photographs of the original and plagiarism are awesome. Attached comparative photographs of the work. The copy was made without the permission of the artist, not even his name or authorship is mentioned, which is clearly an offense under Law 17.336 on intellectual property in Chile.

   Sadness gives remember the harsh treatment that exerts justice against humble people who pirate movies and hesitant to act when faced with large companies.
