EUROPEAN UNION: Study in support of the review of the EU regime on the small-scale driftnet fisheries

 

Executive Summary


Introduction
During the late 1970s and 1980s large-scale driftnets with large mesh sizes and net lengths of tens of kilometres were in use. These ‘large-scale’ driftnets resulted in significant amounts of incidental mortality of protected species including cetaceans, sharks and rays leading to international concern of their environmental impacts.


The uncontrolled use of these large-scale driftnets had devastating effects on many vulnerable marine species and consequently led to attempts by the EU to apply stricter legislation on these gears.


Despite the historical use of small-scale driftnets, i.e. those using both small mesh sizes and nets up to ~2km in length in EU coastal zones, the knowledge and information available on these fisheries remains scarce and scattered. Limited information is available on gears, fishing capacity and fleet activity, composition of catches, and eventual impacts on vulnerable species and the environment in general.


A preliminary internal analysis by the Commission has highlighted some weaknesses in the current EU legal framework on driftnets that may facilitate circumvention of the law. An updated knowledge of driftnet fisheries is required, to assist in the evaluation of the current regime and in the alternative policy options as a basis for an impact assessment to support a new Commission proposal improving the EU regime of driftnet fishing.


Objectives


The main policy purposes for a review of the EU regime on driftnet fishing are as follows:


• To identify and eliminate, to the extent feasible, any possible persisting environmental and conservation problems related to the use of driftnets in relation in particular to protected species (e.g. marine mammals, sea turtles) or other sensitive stocks (e.g. salmon);


• To eliminate shortcomings in the EU legal framework that may undermine implementation and weaken control and enforcement;


• To contribute to better achievement of the objectives and targets for "good environmental status" as established under the Marine Strategy Framework Directive as well as other conservation legislation such as the Habitats Directive;


• To comply with EU's international obligations vis-à-vis the proper implementation of rules on driftnet fisheries;


• To reconcile the EU regime on driftnets with the discard-ban policy under the reformed CFP.


The specific objectives are firstly, to update the knowledge and description of currently active driftnet fleets, both within and outside of the EU (where possible), detailing the fisheries and metiers within which these fleets are active and the likelihood of their interactions with unauthorised and/or protected species, as well as information on the socio-economic characteristics of active driftnet fleets.


Secondly, an assessment to evaluate to what degree the existing EU regime on driftnets has met the objectives set is required through a retrospective evaluation, thereby to identify the best policy direction for future driftnet regime in the context of a reformed CFP through a prospective evaluation.


Evaluation Methods


A review of the regulatory instruments comprised the first step to the Evaluation and served to define a set of Evaluation Objectives, based on the regulatory objectives, used to frame the development of an evaluation matrix for the retrospective evaluation. These Objectives are summarised in the table below.


The Retrospective evaluation was assessed against five evaluation criteria including Relevance, Effectiveness, Efficiency, Coherence and Acceptability.


The data collection programme involved case studies designed to meet the joint requirements of both the retrospective and prospective evaluations, and to provide sufficient coverage of Member States
(MS) across the regions to be evaluated: Baltic Sea, Black Sea, North East Atlantic, the North Sea (including the Kattegat and Skagerrak) and the Mediterranean. Selected case study Members States included: Bulgaria, Denmark, France, Ireland, Italy, Poland, Portugal, Romania, Sweden and the United Kingdom.
