Judge: Typo on search warrant of business means it's no good

Judge: Typo on search warrant of business means it's no good | Amendment 4 | Scoop.it
An apparent typographical error on a search warrant led a judge Monday to bar prosecutors from using any evidence seized in a controversial raid of a Halls driving school against its owner — a retired veteran homicide investigator.
Dan Caputo's insight:

I picked this because it shows that everyone can mess up. It isn't ok to mess up on search warrant for a case. IIts a great example for a warrant gone bad and that every thing has to be perfect on a search warrant

khedlu17's curator insight, April 16, 2014 5:40 PM

This article talks about the 4th Amendment. The 4th Amendment is part of the US Constitution. Why this relates to government and law is that it protects people's rights. The 4th Amendment states the rights of people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.

naknuts37's curator insight, April 19, 2014 10:15 PM

In response to khedlu17:

The 4th Amendment protects the rights of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures. What are some of the circumstances that police can arrest someone without a warrant? What would be an example of probable cause to search someone's house?

Dan Caputo's insight:

I found this video on youtube. I picked it because it showed a good example of probable cause that the student took the money. Also that it was a case that it was about a case that happened in New Jersey.

Murder Case Upended After Police Read Phone Texts Without A Warrant | Techdirt

Murder Case Upended After Police Read Phone Texts Without A Warrant | Techdirt | Amendment 4 | Scoop.it
There have been a number of cases on the legality of police going through your mobile phone, and the courts are basically all over the place on rulings, with very little guidance from the Supreme Court.
Dan Caputo's insight:

This is a good example of the cops messing up. The cops cant use the evidnce from the phone because they didnt have a search warrant to take the evidence form the phone

4 years after probe, no justice for victims of alleged cop misconduct | Amendment 4 | Scoop.it
JOSE DURAN thought he'd find justice after releasing a video that showed narcotics officers cutting wires to his surveillance cameras before they allegedly looted his bodega.
Dan Caputo's insight:

Thiis was an interesting story. The copl lied saying that he had a search warrant and arrested this guy. And the court still wont do anything about it. I went to google news and find this article.

police swat search warrant

SWAT search warrant for drugs in a house
Dan Caputo's insight:

This is a very good example of a search warrant. The cop said "that its the police we have search warrant open up." so they have the right to go into the house and arrest the people

Dan Caputo's insight:

I pick this beacuse it seemed that the police can bend the rules a little bit more.I think that they should of over ruled the evedince because they made a big mistake.
