The privacy law of the United States (US) and European Union (EU) differs in many fundamental ways, greatly complicating commerce between the US and EU. At the broadest level, US privacy law focuses on redressing consumer harm and balancing privacy with efficient commercial transactions. In the EU, privacy is hailed as a fundamental right that trumps other interests. The result is that EU privacy protections are much more restrictive on the use and transfer of personal data than US privacy law.

Uno de los conceptos que traté fue precisamente el de "personally identifiable information" y cómo es posible la desanonimización de los datos con el fenómeno del Big Data.

ISPs will be barred from blocking or throttling customers' access to services that rival their own under new net neutrality rules that could soon be enforced across Europe. The European Commission said that around 100 million Europeans face restrictions on their internet services because ISPs are reluctant give customers access to services which compete with their own offerings. We will guarantee access to the full and open internet on every device, on every network, says the EU's digital chief.

U.S. government agencies and members of the European Union (EU) on Thursday teamed up for a daylong exercise aimed at clarifying how to best communicate about cyber incidents. During the first-of-its-kind exercise, called “Cyber Atlantic 2011,” participants from the U.S. Homeland Security and Justice departments, and more than 20 EU member states were presented with two hypothetical cyberattack scenarios. Cyber Atlantic 2011 aimed to clarify how the two nations can best communicate about cyber incidents that occur on government systems or critical infrastructure.

El abogado general del Tribunal de Justicia de la Unión Europea ha concluido este martes que Google no es responsable de los datos personales incluidos en las páginas web a las que remite su motor de búsqueda y que la actual normativa europea no ampara "un derecho al olvido absoluto", ya que "no confiere al interesado el derecho a dirigirse a un proveedor de servicios de motor de búsqueda para impedir que se indexe información que le afecta personalmente,publicada legalmente en páginas web de terceros".

Activist: “Nothing, not even ACTA, caused the US to lobby on this scale." And by all accounts, lobbying pressure from American government representatives and their corporate allies is intensifying at an unprecedented level as the draft amendments for data protection reform make their way through various committees pushing to strengthen what the European Commission has proposed. One economic officer in the US Foreign Service even commented this week that the current reform draft could "instigate a trade war" with the US.

Que gusto que estén mejorando la legislación de protección de datos personales en Europa, sin duda están sentando un precedente mundial en la materia. Ojalá algún día Estados Unidos entienda que la protección de datos personales debe ser un derecho universal de todos los ciudadanos e internautas.

The “Industry” Committee of the EU Parliament unanimously adopted a resolution on Net neutrality. Through this vote asking the European Commission to promptly assess the need for further legislative action, the Parliament is taking a strong stance in favour of Net neutrality. Pressure now increases on EU Commissioner Neelie Kroes, who may soon be forced to break away with her failed “wait and see” approach and take action.

Earlier this year, the Congressional Research Service (CRS) did a legal review of ACTA to see if it conformed with existing US law. While the USTR tried to keep the report buried, it eventually came out -- and basically said that ACTA was drafted in a dreadfully confusing and opaque way. The issue? It's not even clear if US law conforms to ACTA, because ACTA can be interpreted in many different ways -- some of which suggest the US is in compliance, and some of which say we're not.

Faced with increasing cyber attacks, the EU is looking at a new law criminalising the use of 'zombie' computers and is setting up a 'cyber crime' agency and special teams of IT firefighters to prevent further attacks. A draft law put forward by the EU commission in 2010 on criminalising the spread of malicious software used to launch attacks on government or private company servers is only in the early stages of parliamentary work and still has to be agreed with member states.

Consejo de la UE aprueba la adopción de la regla de la Comisión sobre los escáneres corporales

El Consejo de la UE anunció, el 26 de septiembre de 2011, que no se opondría a la adopción por la Comisión Europea de un Reglamento que permita el uso de los escáneres de seguridad para el control de pasajeros en los aeropuertos de la UE.
