The process for appointing provincial court judges in Alberta should be reformed because it favours candidates with ties to the Progressive Conservative party, lawyers say.

Wachowich says a culture of patronage prevents many lawyers and judges from speaking out on the issue.

 

"You don’t dare stand up and yell too loudly about these things because you might be deprived of some other things that you may wish that come from the minister of justice," he said.

CBC News obtained the internal memo and showed it to Paul Moreau, a former Crown prosecutor and lawyer for the association that represents Alberta prosecutors.

 

“I find that is just a stunningly wrong statement, particularly being a statement made by the deputy minister of justice,” Moreau said, adding later that, “if Crown prosecutors took this as their stated goal, it would certainly not lead to fair and just trials.

 

“It could lead to miscarriages of justice on a broad scale,” he said.

Jennifer Koshan, a human rights law expert at the University of Calgary, said the Palliser situation shows why the government’s bill is flawed in leaving the decision about constitutionally guaranteed rights in the hands of trustees.

 

“There are some school boards out there that explicitly condone homophobic policies,” Koshan said.

 

“The human rights of gay and lesbian students can’t be overshadowed by respect for local autonomy.”

Liberal Laurie Blakeman introduced Bill 202, the Safe and Inclusive School Act, mandating schools to allow students, if they wish, to create gay-straight alliances to combat bullying
Jody MacPherson's insight:

A vote against this bill puts partisan interests ahead of the best interests of children. We need to undo the damage of Bill 44, a terrible piece of legislation that created this problem in the first place.

 

If the PC's do not vote in favour of the bill, I think it will be clear they are the same or worse than the Wildrose Party.

 

It's time to do right by the children of Alberta and stop creating an environment of intolerance in our publicly-funded schools.

The head of a $16.4-million government-funded project that shows more than half Alberta’s young children lag in at least one area of development says she hasn’t been able to get commitment from government to follow up the project’s recommendations. The final report of the Early Child Development Mapping Project (ECMap), completed in August and obtained Friday by the Journal, makes six detailed recommendations designed to improve troubling Alberta data on children’s physical, intellectual, language, social and emotional development.

"I'm baffled as to who they consulted with, and I can't imagine that they consulted with any significant legal body that wouldn't say this is probably discriminatory and probably against the Alberta Human Rights Act. I can't imagine that any legal opinion would be anything except that."

Watch Kent Hehr ask the Minister of Education Gordon Dirks why he approved modulars for a school in Calgary Elbow where he was running to be elected in the recent by-election, bypassing a long list of other schools in other locations the CBE had given a higher priority.

 

Wouldn't Dirks be in a conflict of interest because he would stand to gain personally from his decision as Minister during an election campaign? How is this allowed?
