For the first time in the UK, an ex-employee who resigned from his job to start his own consulting business has recently been ordered by the English Courts to hand over his LinkedIn contacts to his former employer. Despite the fact that employers often encourage their staff to create their own profile through business-focused networking websites such as LinkedIn, the judgment went against the employee. The court ruled that because there was a risk that the ex-employee may have attempted to poach clients from their former employer by using contacts on this database, then its ownership should sit with the employer.

Way back in 2011 the Office of Tax Simplification proposed that, in order to reduce the administrative burden on the UK’s businesses, National Insurance Contributions and Income Tax should be merged. The end goal was to consolidate two different taxes, which have two different rates, into a single tax with a single rate, payable by all employees. The OTS recognised this was a long-term goal, but in the 2012 Budget Chancellor George Osborne made it clear he was taking a long, hard look at the reform, and there is a distinct possibility it may see the light of day at the 2013 Budget.

A debate over whether Britain’s self-employed ranks are only growing thanks to an army of laid-off employees, or due to individuals’ sheer entrepreneurial spirit, is being stoked by official figures.

Released by the Office of National Statistics this week, the data show that unemployment fell by 45,000 to 2.6m in the quarter to March, at the same time as self-employment reached a new high.

In fact, the number of self-employed people increased by 89,000 between January and March to 4.6m, the highest figure since comparable records began in 1992, the ONS said.

Advisers to freelance company owners range from disappointed to distressed in their reactions to ‘improved’ IR35 guidance from Revenue & Customs, saying the taxman has missed an opportunity then made a bad situation worse.

Unveiled on its website last week, HMRC’s package (PDF) is broadly in line with the advisers’ expectations – it contains new guidelines on the legislation; on six new IR35 Scenarios (or Examples), and a ‘business entity’ test.

Now the PCG have added some colour to proceedings with a poll showing that 77% of freelancers and contractors have not been impacted “at all” by the AWR, while a further 16.3% say they have only been affected “a little” (most likely through a move to an AWR-compliant contract, a limited company or a Swedish Derogation Model solution).

Of the respondents only 6.7% said the AWR had impacted them “a lot”.

Despite welcome news today that inflation dropped to 3% in April, the Chartered Institute of Personnel and Development (CIPD) is warning that employers are continuing to struggle to close the gap between basic salaries and the cost of living. The prediction is based on the CIPD’s Labour Market Outlook survey of more than 1,000 employers, which shows that pay award expectations for the next 12 months have fallen to 1.5% from 1.7% compared with three months ago*. Public sector organisations’ predictions of average basic pay awards of 0.3% will continue to lag behind those organisations in the private (2.2%) and voluntary sectors (1.7%).

Mobile and flexible working, not cost, are the main reasons for UK SMEs moving to the cloud, according to YouGov research.

Two-thirds (67 percent) of the 530 UK SME senior managers surveyed had either already implemented cloud services or anticipated they would do so in the future, with 30 percent looking to do so within the next two years.
