Police seizure of text messages violated 4th Amendment, judge rules

Police seizure of text messages violated 4th Amendment, judge rules | 4th Amendement-AdileneVera-Lopez | Scoop.it
But legality of warrantless cell phone seizures is still unsettled nationwide.
Adilene Vera-Lopez's insight:

A police violates a mans 4th amendment right by going through his text messages. In this article I believe that at times it was okay to violate his fourth amendment right but, at the same time I don't. I believe that it is wrong because he shouldn't just get his phone and start going through the messages and reading them without his permission. Then again. I think it was good that the police did that. If the police never gone through his messages they wouldn't have found out that Platino murdered Marco.

Adilene Vera-Lopez's insight:

This video I found was meant to be an educational video, which was meant as a good example for my scoop-it. The boy comes to judge telling him that a police officer did an unlawful search and seizure on him. While the police officer was searching him he happened to find a bag of coccaine. The boy thinks his case his case should be dissmissed. He asks help from a judge to see what he thinks if it should or shouldn't. This is where the judge starts to talk about the fourth amendment.

The Fourth Amendment

Adilene Vera-Lopez's insight:

What this article really does is sums up the steps of what goes on in the fourth amendment. To what the court would ask and what would happen. It also explains the purposes to why state officials would need to go in ones' house. It explains a small part to why at times there are struggles in this amendement. Finally, telling to where the objects or resources they get from some ones house would go to and who would use the information.

Fourth Amendment News. Find breaking news, commentary, and archival information about Fourth Amendment From The Los Angeles Times
Adilene Vera-Lopez's insight:

These two short articles state that people notice that they are not given their fourth amendment. In the first article it states that children don't have the same amendment right as adults. I would give my opinion that it shouldn't matter the age on who has more rights toward the fourth amendment. Also, the fact that the FBI could always track everything is just against our fourth amendement. I understand that it's just for saftey but I still believe that we need our own personal life to stay just towards us, not the FBI.

Adilene Vera-Lopez's insight:

In this video this man is standing up for his rights. He starts to state that they can not come in his property. He tells the sheriff and the lady that they do not have the right to come in his property with out a warrent signed by a judge. The lady asks for his name and he still states that under the constitution of Indiana he has the right that he doesn't have to state his name. He decides to record the trasspassing in his property no matter how many times this man was stating his rights. The right that they didn't have the right to come in his property.

The Fourth Amendment

The Fourth Amendment | 4th Amendement-AdileneVera-Lopez | Scoop.it
The text, origins, and meaning of the Fourth Amendment to the U.S. Constitution.
Adilene Vera-Lopez's insight:

In this article it states what the fourth amendment is and the purpose to why it was made. In this case it was made in response to British general warrents. Which in that point the British could go into any home. They could go any time they would want. The British did not have to have a reason in to which why they would go into ones' house.
